Item 10, the Trade in Animals and Related Products (Wales) (Amendment) (EU Exit) (No. 3) Regulations 2021. I call on the Minister for Rural Affairs and North Wales, Lesley Griffiths.
Thank you very much, Deputy Presiding Officer, and thank you for the opportunity to introduce the Trade in Animals and Related Products (Wales) (Amendment) (EU Exit) (No. 3) Regulations 2021. I move the motion.
These regulations are made using the made affirmative procedure under powers conferred on Welsh Ministers by the European Union (Withdrawal) Act 2018. They were laid before the Senedd on 28 September, and came into force on 29 September. The original Trade in Animals and Related Products (Wales) (Amendment) (EU Exit) Regulations 2021, approved by the Senedd earlier this year, changed the date from which transitional requirements of prior notification for import into Wales of products of animal origin apply from 1 April 2021 to 31 July 2021. The requirements were again delayed by the Trade in Animals and Related Products (Wales) (Amendment) (EU Exit) (No. 2) Regulations 2021, delaying them from 31 July to 1 October 2021, a change approved by the Senedd on 21 September 2021. These regulations further amend Schedule 5 to the Trade in Animals and Related Products (Wales) Regulations 2011 to change the date that transitional requirements of prior notification for imports into Wales of products of animal origin apply from 1 October 2021 to 1 January 2022.
As the other administrations had previously agreed to extend the transitional period, further changes have also been made to retained EU law in Wales and England by the UK Government, with the consent of Welsh Ministers. Due to the lack of availability of the Scottish Parliament at a crucial stage of the process, the Scottish Government made similar amendments to the same effect by way of separate legislation. To align with the changes to legislation in England, these regulations also remove the requirement for products of animal origin and animal byproducts to be accompanied by the appropriate health certificate for third country imports before the end of the transitional staging period. The Scottish Government amended their equivalent regulations to instead delay this requirement until 1 January 2022. My officials will continue to monitor the situation and work with other devolved Governments to ensure a harmonised import regime across Great Britain. Diolch.
